These Terms & Conditions (“Terms”) govern your use of the services provided by W.H. Peters Outdoor Adventures LLC (“Company,” “we,” “our,” or “us”), including kayak tours, eco-tours, and kayak instruction. By booking, participating in our activities, or using our website, you agree to these Terms.

1. Booking & Payment
All bookings must be made through our website.
Payment is due at the time of booking.
You must provide accurate personal and contact information.
You must be at least 18 to book, or a parent/guardian booking for a minor.

2. Cancellation Policy
To ensure the best possible experience, we limit the number of participants per tour. Therefore:
Customer Cancellations
Groups of 4 or more must cancel at least 48 hours before the scheduled tour to receive a refund.
Groups of 3 or fewer must cancel at least 24 hours before the scheduled tour to receive a refund.
These rules apply to all members of your party.
Failure to cancel within the required window results in no refund.
Weather Cancellations
We reserve the right to cancel any tour at any time if weather or conditions create an unsafe situation.
Tours canceled due to weather will receive a refund.
Tours are not canceled for light rain or drizzle.
Tours will be canceled for thunder or lightning.
Weather may differ between your location and the tour location — we make the final safety call.
If you are uncomfortable with this, we suggest waiting closer to the tour time to book.

3. Late Arrival & No-Show Policy
Please arrive 15 minutes before your scheduled tour time.
No-Shows
Guests who do not arrive for their tour are considered no-shows.
No-shows do not receive a refund.
Late Arrivals
Tours begin exactly at the scheduled start time.
If you arrive late without calling before the start time, the tour will launch as scheduled, and no refund will be issued.
If you call ahead, we will try to accommodate you; however, accommodation is not guaranteed and depends on safety and group needs.

4. Liability Release Requirement
All participants are required to sign a Liability Release & Assumption of Risk Form before participating in any kayak tour, eco-tour, or kayak instruction session.
Every member of your party must sign, including minors.
A parent or legal guardian must sign for any participant under 18.
Participants who do not sign the required form will not be permitted to join the activity, and no refund will be issued per the cancellation and no-show policies.
By booking, you acknowledge and agree to this requirement.

5. Weather, Water Conditions & Safety
Outdoor conditions can change quickly. For the safety of all guests, we may:
Modify the route, pace, or duration of the tour
Change the launch location
End a tour early
Require participants to wear safety equipment (including PFDs)
Remove any participant who poses a safety risk to themselves or others
All safety decisions by guides or instructors are final.

6. Participant Requirements
By participating, you confirm that:
You are physically and mentally capable of kayaking
You do not have medical conditions that would place you at risk
You will follow all instructions from guides and instructors
You agree to wear a provided life jacket (PFD) where required
Some activities may have minimum age, weight, or skill requirements.

7. Assumption of Risk
Kayaking and outdoor activities involve inherent risks, including but not limited to:
Changing weather and water conditions
Capsizing or falling into the water
Wildlife encounters
Slips and falls
Muscle strain, fatigue, or overexertion
Equipment malfunction
By participating, you voluntarily assume all risks and agree that the Company is not liable for injuries or property damage unless caused by our proven negligence.

8. Personal Belongings
We are not responsible for:
Lost or stolen items
Water damage to phones, keys, wallets, cameras, or other personal belongings
Waterproof storage is not guaranteed. Bring valuables at your own risk.

9. Photos & Media
We may take photos or videos during tours for promotional use.
If you do not want to be photographed, please inform your guide before the tour begins.

10. Privacy
Your use of our services is governed by our Privacy Policy, which explains how we collect and protect personal information.

We may modify our offerings, policies, availability, or pricing at any time. Updates will be posted to our website.

12. Limitation of Liability
